How to disassociate from a Criminal Motorcycle Gang

From July 1, 2014, the licensing requirements in a number of industries will change and active members, or associates, of declared criminal organisations (including Criminal Motorcycle Gangs) will be prohibited from gaining licences to work in those selected industries.

The Queensland Police Service (QPS) has introduced a process where people can disassociate from a Criminal Motorcycle Gang (CMG).

Those wishing to disassociate and show they no longer have links to a CMG should complete a Disassociation Declaration or a Statutory Declaration.
The completed form, and associated documents, should then be either emailed to QPolCrimOrg@police.qld.gov.au, posted to QPS State Intelligence, GPO Box 1440, Brisbane Q 4001 or handed in at any police station or police beat.

Once received by QPS, the completed declaration of disassociation will be noted and taken into account should the QPS have cause to assess your status as a participant in a criminal organisation as required by law or otherwise.

Frequently Asked Questions

What type of information do I have to supply to get approved for disassociation?
You will need to present information which shows that you have met all the requirements of the organisation to renounce your membership or sever your ties.

How long will it take for my application to be assessed?
Timeframes will vary from application to application, dependent on the level of information provided and the number of supplementary checks the QPS will have to undertake to verify the information provided.

The QPS will aim to respond to your application in a timely manner to ensure any license application is not unnecessarily delayed.

Do I have to complete this application?
No. However, your application for any license may be effected if you continue to be associated with a criminal organisation.

What if it has been longer than 14 days and I have not responded to the letter can I apply for disassociation?
You can apply to disassociate at any time but any unnecessary delay may have an impact upon the issue of any license for which you may apply.

How will I be advised of the outcome?
The Regulatory Authority will advise you if your licence is approved or refused.  They will also inform you of the reasons, including any advice from the QPS concerning your disassociation application.

Can I appeal the decision?
Legal avenues may exist for an appeal or a review depending upon the type of license or action taken by the Regulatory authority.

What will happen with the information I provide?
The Queensland Police Service is subject to the Information Privacy Act 2009 which regulates the collection,  management,  use and disclosure of personal information.  The information you provide will be stored securely and will only be used for the purpose of processing your disassociation application.

The information will not be used for other purposes without your consent unless such use is authorised or required by law.

The information may be disclosed to other government agencies, including law enforcement agencies in order to process your application.  It may also be necessary to disclose some of the information to third parties in order to clarify details in your application.  However, the QPS will only contact those third parties where there is no other reasonable way of clarifying these details.

Otherwise,  the information you provide will not be disclosed without your consent unless the use or disclosure is required or authorised by law including under the Police Powers and Responsibility Act 2000, the Vicious Lawless Association Disestablishment Act 2013 and the Information Privacy Act 2009.

Do I have to have a lawyer review my application?

There is no legislative requirement for you to obtain legal advice prior to submitting your application. This is a personal matter for you to consider.

How long does this disassociation last for?
There is no specific timeframe nominated.

Do I have to tell my employer?
Any information you provide to your employer is a matter for you to consider.

If I am successful in my disassociation does this mean I will definitely get my license renewed?
The final decision as to whether a license is issued is with the Regulatory Authority responsible.
