
NOISE COMPLAINTS
Noise complaints can be received from a member of the public or be initiated by a Police Officer when excessive noise is being emitted from a place by either:
* Musical Instrument
* An appliance for electronically producing or amplifying music or other sounds
* A gathering of people for a meeting, party, celebration or similar occasion
If a Police Officer is satisfied that the noise is clearly audible at or near residential or commercial premises and is excessive in the circumstances the Police Officer may:
* Enter the place with a warrant
* Require the person responsible for the noise to state their correct
name & address and provide identification
1st complaint received -The officer must give the person
responsible for the noise, a noise abatement direction to
immediately abate the excessive noise and comply with direction for
up to 12 hours afterwards
2nd Complaint received- and a direction has already been given
to the responsible person, police can begin investigations into the
non compliance of the noise abatement direction. The responsible
person may end up before the court for disobeying the police noise
abatement direction.
In relation to the property that is or was being used to produce or contribute
to the production of the noise police may either :
Lock, seal or otherwise deal with it in a way to prevent its further use;Seize and remove it from the place; or
Make it inoperable by removing any part and seizing and removing
the part or parts from the place.
Note: Noise Complaints about motor vehicle can also be reported to
Police. Complaints about open-air concerts, commercial entertainment,
or public meetings should be referred to appropriate authority
( EPA, Council, Liquor Licensing)
